Terms & conditions

Article 1 — Field of application

THAKI defines its terms and conditions (T&C) according to the specifics of its trips. Registration for one of our trips implies their acceptance. THAKI is a company incorporated under Bolivian law and is, as such, subject to Bolivian law. Likewise, upon entering the territory, our clients must submit to the laws of the country, and any violation of Bolivian laws and the corresponding consequences are their responsibility.

Article 2 — Registration and regulations

Registration for one of the THAKI services implies acceptance of our general conditions of sale. Registration is final upon receipt of the completed registration form and the down payment for your trip.

2.1. For any registration to our trips:

All registration forms must be completed and validated by the participant before being sent to THAKI. For registrations made more than 30 days before the departure date, the registration form must be accompanied by a deposit of 40% of the total amount of the trip. If accepted, the full insurance premium must be paid (you have 48 hours to take out a cancellation insurance). An invoice will be sent to you within 10 days of registration. The balance must be paid imperatively one month before the departure date, without any reminder from us. If you register within 30 days of departure, the total amount is required upon registration. The registration must be completed precisely with the first and last names appearing on the passport of the participants.

2.2 Modifications and special conditions

If the full names are changed after registration and if tickets have already been issued, you will be charged for new tickets issuance.

  • Minors: any registration of a minor must be signed by the parents exercising parental authority. Underage travelers must be in possession of the necessary documents (authorization to leave the territory; be careful, no children over 15 years old on the parents’ passport). THAKI cannot be held liable in the event of failure to supervise the accompanying person.
  • Physical fitness: for all trips, the participant must ensure that their physical condition is suitable for the planned tour. THAKI cannot be held responsible for any physical insufficiency during a tour.

Before any registration, THAKI strongly recommends that everyone be aware of the safety instructions, health and climatic conditions of the country visited. To do this, you can consult the files on the US Embassy in Bolivia website (https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories/bolivia-travel-advisory.html). In certain circumstances, THAKI may be required to have you sign one or more of these forms, as an information obligation.

Article 3 — Prices

Our prices are expressed in American dollars (USD), the international trade currency used in Bolivia, in order to be as close as possible to the real cost of our suppliers. In the event of a significant fluctuation (more than 5% general increase) of the elements having a direct impact on the price of the stay (exchange rate between the USD and the Boliviano (BOB), transport price following oil price changes, inflation, increase in entry prices to tourist sites, etc.) between the signing of this contract and one month before the start of services, we may find ourselves obliged to modify the defined price.
In this case, the traveler has the choice between:

  • Cancelling their trip. They will then be reimbursed for all payments made, less bank charges and administration fees ($200 USD per participant).
  • Confirming their agreement on the new proposed rate.

The final price of the trip is that specified in the last version of the program sent by THAKI. The rate is calculated based on the number of passengers — a change in the number of participants may therefore lead to a change in rate and/or services.

Article 4 — Terms of payment

Registration will be considered effective with the payment of a deposit representing 40% of the total amount of the services. The balance must be paid 30 days before the actual start of the services. Payment terms:

  • Bank transfer to our bank account in Bolivia. Must be effective before the start of services.
  • Credit card (2.50% processing fee added to the total, via the secure Libelula system).
  • Payment directly at the Thaki office in Bolivia (2.50% credit card fee if applicable).
  • For bank transfers, please send a copy of the transfer to facilitate traceability.
  • International transfer fees are the traveler’s responsibility (check with your bank).

Article 5 — Conditions and penalties for cancellation

In case of cancellation, for any reason, costs external to the trip incurred by the traveler (transport to the departure point and return home, visa, travel documents, vaccination, insurance, bank charges) cannot be reimbursed.

5.1 By the customer

A.1. If the traveler has to cancel for personal reasons (illness, death in the family, etc.), the sums paid will be reimbursed subject to the following deductions:

  • More than 90 days before departure: deposit fully refunded, less bank charges and a fixed $200 USD per person, plus the amount of any air tickets already issued.
  • Covid clause exception: Under no circumstances will quarantine in Bolivia trigger a refund of your deposit. We will offer a credit note valid for 2 years.
  • More than 50 days: 15% of the total price.
  • 50 to 31 days before departure: 30%.
  • 30 to 16 days before departure: 60%.
  • Less than 15 days before departure: 100% retained.

Airline tickets cannot be refunded once the Agency has purchased them; they cannot be modified or exchanged.
A.2. If the customer cancels after a rate increase by Thaki under Article 3, they will be refunded in full, less bank charges and administrative costs.
A.3. Cancellation of one participant in a group: prices will be recalculated according to the new participant count. The client can either reject the new price (subject to §5.A.1 conditions) or confirm and sign a new contract.

5.2 By THAKI

If THAKI has to cancel its services in case of force majeure (strikes, political unrest, security issues, etc.), or for safety reasons, or by administrative injunction, THAKI will propose a postponement valid for 1 year. THAKI cannot be held responsible for the consequences of these events and no reimbursement or compensation can be claimed.
We strongly recommend taking out specific travel insurance. Our partner Atrio Travel Assist offers cancellation and on-site assistance insurance.

Article 6 — Interruption and/or modification of the trip

By the customer — Before departure: any modification request made after registration is assessed case by case. Modifications after the issuance of tickets are treated as cancellation + new issue at traveler’s expense. During the trip: if the customer modifies or interrupts the trip prematurely, or decides not to participate in a programmed activity, no reimbursement of unused services will be provided.
By THAKI — THAKI reserves the right to modify or interrupt the trip in force majeure cases. Alternatives best suited to the modified or canceled services will be offered to minimize impact. In case of interruption with repatriation, no reimbursement or compensation will be granted — contact your insurer.

Article 7 — Formalities

Travelers must inform themselves about administrative (visas, etc.) and health (vaccines) formalities before registering, in particular from competent embassies and consulates. Each traveler must comply with police and health regulations throughout the trip. THAKI cannot replace the customer’s individual responsibility in obtaining formalities (passport, visa, vaccination record) — including customs formalities (fabrics, antiques, etc.). The passport must be valid for at least 6 months after the end of the stay. For trips to South America with international flights via the USA, verify ESTA eligibility.

Article 8 — Insurance

We ask travelers to take out cancellation insurance and multi-risk personal repatriation assistance. THAKI is insured for professional civil liability, but cannot replace the individual civil liability of each participant. Thaki recommends Atrio Travel Assist. The general and specific conditions are available on the website or on request. Insurance must be taken out at the time of registration. In all cases, do not forget to take with you a copy of our contract (or your personal insurance details) when traveling — you are responsible for reporting claims to your insurer (our guides and local agencies will of course help in this process).

Article 9 — Liability

THAKI cannot be held responsible for the consequences of external events such as:

  • Failure to present identity documents or presentation of outdated/insufficient ones.
  • Given the special nature of our trips, each participant must comply with the guide’s instructions. The agency cannot be held responsible for incidents resulting from imprudent personal initiatives.
  • Each participant must be aware that they may run risks due to local conditions (distance from medical centers, communication gaps, infrastructure quality) and assumes them in full knowledge of the facts.
  • Good physical condition and a sense of respect and friendliness are essential to enjoy our trips. We invite you to consult your doctor before traveling, particularly regarding altitude.

Article 10 — Complaints

Any complaint should be sent to THAKI. We will do everything to reach an amicable agreement. In the event that no agreement is reached, THAKI is governed by local law and the courts of Bolivia will be considered competent.

Article 11 — Air transport

Schedule changes, route changes, stopovers, delays, missed connections, denied boarding, flight cancellation, change of airport, strikes, technical incidents, bad weather, air overloads, natural disasters and third-party incidents — and all their consequences — cannot engage THAKI’s responsibility. Additional costs related to disruption remain at the traveler’s expense.

Article 12 — Luggage

During the trip, luggage may be carried by rudimentary means of transport (mules, 4×4…). It must therefore be adapted to these conditions. THAKI cannot be held responsible for any deterioration. All baggage or personal effects remain the traveler’s responsibility at all times. If your stay takes place with a guide, in no event shall they be held responsible for your luggage or personal effects.
